Anya Yoga LLC, a New York limited liability company (“Anya Yoga,” “we,” “us,” or “our”), owns and operates this website and any related sites, apps, social media pages, and services we offer now or in the future (the “Site”).

By using the Site or any of our products or services (“Products and Services”), you agree to these Terms of Use and our Privacy Policy (together, the “Terms”), which form a binding agreement between you and Anya Yoga. If you’re using the Site on behalf of a business, you confirm you have authority to bind that business, and “you” includes both you and it.

By using any part of the Site or our Products and Services, you confirm you’ve read, understood, and agreed to these Terms, including the Terms of Sale, arbitration provisions, class action waiver, disclaimers, and limitations of liability below.

If you access Anya Yoga content through a third-party platform (Instagram, Facebook, Pinterest, X, etc.), you’re also subject to that platform’s terms.

Healthcare Disclaimer

Anya Yoga isn’t a medical practice and doesn’t provide medical, mental health, or other licensed healthcare services.

Nothing on the Site, or in any class, workshop, session, or program, including hot yoga, substitutes for professional medical advice, diagnosis, or treatment. We make no warranties about the completeness, accuracy, or suitability of information provided through the Site or our Services.

Talk to your physician or another qualified provider about any medical condition or health concern before acting on information from the Site or participating in a class, including hot yoga classes held in a heated room.

Participating in our classes, including hot yoga, may involve risk, such as physical injury, heat-related illness, emotional distress, or other harm, and you’re voluntarily assuming those risks. Never delay or disregard professional medical advice because of something you read here.

To the fullest extent the law allows, you release Anya Yoga from claims related to your use of the Site or our Services in connection with these matters, and agree to indemnify us against claims arising from your use or misuse of them. This Section doesn’t limit any separate liability waiver you sign for in-person classes.

Content on the Site

1. Intellectual Property Rights. Everything on the Site, including text, graphics, images, videos, training materials, designs, branding, trademarks, and other content (the “Content”), is owned by or licensed to Anya Yoga and protected by copyright, trademark, and other IP laws.

All trademarks, logos, and branding on the Site (the “Marks”) belong to Anya Yoga or their respective owners. Nothing here gives you any ownership in the Site, Content, or Marks.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Site and Content for your personal, non-commercial use.

You can’t copy, distribute, modify, or otherwise use Content beyond that without our prior written consent. Unauthorized use may result in legal action, and we may monitor use of the Site to check compliance.

2. Third-Party Content. The Site may include content or links from third parties. We don’t control or vouch for their accuracy and aren’t responsible for them, or for the practices of any linked third-party site.

3. Third-Party Services. Third parties may offer products or services through the Site, subject to their own terms. We’re not responsible for their acts, omissions, or conduct.

Your Conduct on the Site

1. Eligibility. You must be at least 18 and legally able to enter a binding agreement. If you’re acting on behalf of someone else, you confirm you’re authorized to bind them. If we’ve previously restricted or suspended your access, you may not use the Site without our written permission.

2. Account Information. Keep your account info accurate and current. You’re responsible for your login credentials and for anything that happens under your account, which is personal to you and can’t be sold or shared.

We may suspend or terminate your account if your information is inaccurate or you violate these Terms.

By creating an account or giving us your contact info, you agree to receive electronic communications from us about the Site, your account, purchases, class bookings, and studio announcements. If you’d like text messages too, see the SMS Terms & Conditions section below.

3. Feedback. If you send us comments or suggestions, we can use them freely, without compensation to you, unless we agree otherwise in writing.

4. Prohibited Conduct. You agree not to use the Site or our Content to:

  • Defame, harass, threaten, or otherwise violate the rights of Anya Yoga or anyone else;

  • Use the Site for unlawful, fraudulent, or unauthorized purposes;

  • Copy or imitate the Site’s design, branding, or Content;

  • Reverse engineer or tamper with the Site’s underlying technology, except where the law prohibits this restriction;

  • Disrupt or interfere with the Site or related systems;

  • Impersonate any person or entity;

  • Attempt unauthorized access to accounts or systems;

  • Infringe our IP rights or anyone else’s;

  • Upload viruses, malware, or other harmful code;

  • Remove copyright or trademark notices; or

  • Otherwise break the law or third-party platform terms.

We may take steps to comply with law enforcement requests or court orders concerning your use of the Site.

SMS / Text Messaging Terms & Conditions

If you opt in to text messages from Anya Yoga, the following applies and is part of these Terms.

1. Program Description. Opting in means you agree to receive texts about:

  • Class booking confirmations and reminders

  • Waitlist notifications

  • Account and membership updates

  • Studio announcements and schedule changes

  • Promotions, special offers, and events

Message frequency varies. Opting in isn’t a condition of purchase.

2. Opt-Out Instructions. Text STOP to the number you received the message from, any time. We’ll send one final confirmation that you’ve been unsubscribed, and that’s it: no more texts. Want back in? Just opt in again the same way you did the first time.

3. Help Instructions. Reply HELP if you’re having trouble with the messaging program, or reach us at contact@anyayoga.co or www.anyayoga.co.

4. Carrier Disclaimer. Carriers aren’t liable for delayed or undelivered messages.

5. Message & Data Rates. Message and data rates may apply. Check with your wireless provider if you have questions about your plan.

6. Privacy. We don’t share your mobile information with third parties or affiliates for their own marketing. Text messaging opt-in data and consent are never shared with third parties for any purpose. See our Privacy Policy for more detail.

DMCA Copyright Infringement and Takedown Policy

1. Infringement Notification. We respect others’ IP rights and expect the same from Site users. We may remove content, suspend access, or terminate accounts if we believe, in our discretion, that content infringes someone’s rights or a user is a repeat infringer.

If you believe material on the Site infringes a copyright you own or represent, send a notice to:

  • The infringing material’s location, including URL and enough detail for us to find it;

  • Your signature.

Notices that don’t meet the requirements of 17 U.S.C. § 512(c)(3) won’t receive a response. Nothing here expands or supplements the rights and remedies granted under the DMCA.

Knowingly misrepresenting infringement, or that content was wrongly removed, can make you liable for damages including costs and attorneys’ fees under the DMCA. Repeat infringers may have their access terminated.

Terms of Sale

1. Products and Services. We may offer products, memberships, class packages, or other offerings through the Site, all subject to these Terms. Pricing is listed on the Site and can change anytime. Fees are due at purchase, booking, or enrollment unless stated otherwise, and we're not obligated to deliver anything until we're paid.

2. Descriptions. We try to keep listings accurate, but don’t guarantee it. We can correct errors or cancel orders based on inaccurate information, even after you’ve submitted one.

3. Availability and Pricing. Pricing and availability can change anytime, without notice. All prices are in U.S. dollars. We can cancel or adjust an order if there’s a pricing error.

4. Orders and Acceptance. A purchase or booking is an offer to buy, which we can accept or reject, limit, or cancel, even after confirming it.

5. No Cancellations; All Sales Final. Unless we say otherwise in writing, all sales, including class packages and memberships, are final; no returns, refunds, or exchanges. We may make exceptions at our discretion, and certain exceptions may apply where required by law.

6. Payment. You authorize us and our payment processors to charge your payment method. Please contact us before initiating a chargeback so we can try to resolve it. We're not responsible for processing errors caused by third-party providers, and we can refuse or cancel transactions we suspect are fraudulent.

7. Taxes. Prices exclude applicable taxes unless stated otherwise; you’re responsible for them.

8. Personal Use Only. Products and Services are for your personal use, with no reselling or commercial use, without our written agreement.

9. Professional Conduct. Please engage with us and our team respectfully. We can suspend or terminate access, without refund, if your behavior is abusive or creates an unsafe environment.

Disputes

1. Informal Resolution. If a dispute comes up, contact us first at contact@anyayoga.co and give us at least 60 days to try to resolve it informally before starting formal proceedings.

2. Arbitration. To the fullest extent the law allows, disputes about these Terms or the Site will go to binding individual arbitration through the American Arbitration Association (AAA). Arbitration is individual only, with no class actions or representative proceedings. The arbitrator has exclusive authority over disputes about these Terms’ interpretation, enforceability, or formation. The Federal Arbitration Act governs this provision.

3. Arbitration Opt-Out. New users can opt out of arbitration by emailing contact@anyayoga.co within 30 days of first accepting these Terms, including your name, address, and account email, and a clear statement that you’re opting out. Existing users get 30 days from any updated arbitration provision. Opting out doesn’t affect the rest of these Terms.

4. Exceptions. Either party can seek injunctive relief in court for IP violations, and eligible claims can go to small claims court individually.

5. Class Action Waiver. To the fullest extent the law allows, disputes are resolved individually, and you waive any right to a class action, class arbitration, or representative proceeding against us.

6. Judicial Forum for Legal Disputes. If arbitration doesn’t apply to you or a particular dispute (whether by opt-out, arbitrator decision, court order, or small claims filing), that dispute goes to state or federal court in Kings County, New York, and you consent to that court’s jurisdiction.

Indemnification

You agree to indemnify, defend, and hold harmless Anya Yoga and its owners, officers, employees, contractors, and affiliates from claims, damages, or costs (including reasonable attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of anyone else’s rights or the law. This survives termination of these Terms.

Warranties and Disclaimers

The Site and our Products and Services are provided “as is” and “as available,” to the fullest extent the law allows. We don’t guarantee the Site will be uninterrupted, secure, or error-free, or that results from using it will be accurate or reliable, or that our Products or Services will meet your expectations.

We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows. We’re not responsible for delays or failures caused by things beyond our reasonable control. Your use is at your own risk.

Limitation of Liability

To the fullest extent the law allows, Anya Yoga and its affiliates, owners, and employees won’t be liable for indirect, incidental, consequential, special, or punitive damages related to your use of the Site or our Services, even if we were warned they might happen.

Our total liability for any claim won’t exceed what you paid us for the applicable Product or Service, or $100 if you didn’t make a purchase. This doesn’t limit liability where the law doesn’t allow it to be limited.

Termination & Survival

These Terms stay in effect until terminated. We can modify, suspend, or discontinue any part of the Site anytime, without liability. Provisions that should survive termination, such as IP, indemnification, disclaimers, limitation of liability, and dispute provisions, will.

General Terms

1. No Waiver. Not enforcing a provision doesn’t waive it.

2. Severability. If part of these Terms is unenforceable, the rest still applies.

3. Governing Law. These Terms are governed by New York law and applicable federal law.

4. Venue. Disputes not subject to arbitration go to state or federal court in Kings County, New York, and you consent to that jurisdiction.

5. Electronic Communications. You consent to receiving communications from us electronically, including by email or through the Site.

6. Entire Agreement. These Terms are the entire agreement between us regarding the Site and our Products and Services.
